Seoul Film Commission Regulations for Filming Support

Article 1 Purpose

Seoul Film Commission (SFC) is an organization established to provide support for filmmaking in Seoul and to contribute to the development of the local film industry through improving the environment for filmmaking and establishing an effective support system.
By acting as the mediator and coordinator between the individual filmmaker and filmmakers ("applicant") and the party having jurisdiction over the filming location, SFC seeks to broaden the foundation of film culture and promote sustainable conditions for filmmaking in Seoul.
The purpose of the regulations set out below is to clarify the points the applicant must observe in order to obtain the services of SFC's.

Article 2 Definitions

Location Scouting Support Basic, (for overseas Location Scouting Support Program see Incentives)
"Location Scouting Support" means hunting for a location that a filming permit can be obtained, acquiring information about the location and making necessary arrangements.

Location Filming Permission Support (Filming Support)
"Location filming permission proceeding" means filming that can affect a third party directly or indirectly that takes place in locations other than filming studios or exclusive filming locations.

Article 3 Support provided

The support that SFC provides is as follows. |

a. |
Online and offline support for location scouting within Seoul. |
| |
b. |
Support in acquiring filming permits in locations within Seoul. |
| |
c. |
Other additional support necessary for film production and matters that SFC considers necessary. |
| 2. |
Location Scouting Support |
| |
a. |
Basic information and photos on various locations are provided at www.seoulfc.or.kr Location Library.

b. |
When there is a request, SFC will provide other additional materials and information offline.
|
| |
c. |
When required, a coordinator will accompany the applicant to the location.
However, this is limited to cases where a coordinator of SFC is required to accompany the applicant in order to discuss a possible filming permit.

Support for acquiring location permission (Filming Support) |

a. |
Support in getting various necessary filming permits |
| |
b. |
Support in public equipment and public manpower needed for filming
|
| |
c. |
Support in finding parking space
|
| |
d. |
When the SFC’s coordinator decides it is necessary, public promotion to mitigate public disturbance.
|

e. |
In case of shooting of a foreign film in Seoul, SFC can also provide support in finding accommodation and transportation arrangements.

f. |
Other matters that SFC considers necessary for the shooting.
|
| |
g. |
After discussion between the applicant and SFC, the scope and details of support will be decided. After the scope and conditions of the particular film production have been carefully considered and the on-location shoot has been discussed with the related jurisdictional body, it will be decided whether or not the movie will receive Film Support, and the scope and range of the support will be determined.

Article 4 Eligibility

All domestic and foreign film productions intending to shoot within Seoul can submit their application to SFC. |
Article 5 Limitations
| 1. |
Materials submitted to SFC cannot be returned, and SFC may not use or illegally distribute the material other than for the purpose of providing support. |
| 2. |
Private property and land is excluded from Filming Support. |
Article 6 Application Procedure

Applicants that either request location scouting support or support for acquiring location permission (Filming Support) should fill out and submit the Filming Support Application Form. Download at www.seoulfc.or.kr. Filming Support / Application. Applications may be made through mail, fax, e-mail, or personal. |

When requesting additional offline support, fill out and submit the Filming Support Application Form (www.seoulfc.or.kr. Filming Support / Application).
Documents to be attached: detailed description for each subject of support being requested ("outline details"), scenario, description of requested location
Application period: 2 weeks before scouting

Submission of application form

① Commercial feature film
Mandatory documents: Application Form and scenario
Additional documents: detailed description for each subject of support being requested, shooting plan, crew contact info
② Independent or short film
Mandatory documents: Application Form and scenario
Additional documents: detailed description for each subject of support being requested, copy of student ID card and professor’s recommendation letter (in case of student film)
③ Other types of film
Mandatory documents: Application Form and scenario
Additional documents: storyboard
2) Period of application: 2 weeks before shooting begins
Provided however, the date of submission will be the date all the documents have been prepared and submitted.
※ Application will be deemed to have been received when mandatory documents are submitted, and if the coordinator requests additional documents or other necessary documents they should be submitted to the Commission.
※ Additional documents and period of application may vary according to the details of support being requested, so it is advised that applicant refer to the "Detailed regulations for each support matter." SFC may require additional documents in order to provide support to the applicant more smoothly.

Article 7 Responsibilities of applicant
| 1. |
The applicant has responsibility for the following, and SFC shall not be liable for any disadvantages caused by breach of such responsibilities. |

a. |
Observing time lines and diligence in submitting required documents
1) In case the application form or documents are inadequate the Commission may require supplementary documents.
2) The applicant should not apply with information intentionally altered or reduced.
3) Immediate notice obligation of any changes.
The applicant should do one's best to meet the information submitted (i.e. shooting location, type of film scene, schedule, number of staff and equipment). In case cancellation or changes are unavoidable, the applicant should immediately give notice to the Commission while discussions are still in progress, and to the Commission and organization having jurisdiction over the location in case the shooting location has already been fixed.

b. |
Shooting cancellation and postponement
In case shooting cannot take place due to changes in shooting schedule, the applicant must give notice to the Commission at least 2 days prior to the scheduled shooting date, and the period for re-submission and obtaining a new permission will be subject to the regulations of the related jurisdictional organization.
However, in case of cancellation or postponement due to reasons set out below, rescheduling is possible after discussion among related parties.

c. |
Obligation to protect shooting location
The applicant must thoroughly clean all garbage and waste generated during shooting, and restore or duly compensate for all buildings or facilities that have been altered or damaged.
In addition, when facilities within the location have been inevitably altered or removed for the shooting the applicant must submit a restoration plan to the Commission, and shall have the obligation to compensate and restore all losses or damages incurred during shooting.

d. |
Obligation to minimize citizens' inconvenience and to protect privacy
1) The applicant must perform prior promotion and obtain sufficient consent in order to minimize any inconvenience to third parties, and make an effort to prepare a plan to resolve any inconvenience that is inevitable.
2) The applicant cannot shoot the private property or physical body of another person without their prior consent.
3) When the Commission deems it necessary for the safety and protection of citizens' property, the Commission may require an oath or pledge, or to get insurance, and the applicant must comply with this requirement.

Article 8 Cooperation by the applicant

As long as there is no particular reason preventing it, the applicant is requested to permit SFC to take still-photos and shoot short videos during the shooting on locations that SFC provided support. However, the applicant may provide terms and conditions of usage of the pictures and videos. |
| 2. |
The applicant is requested to provide publicity material on the movie, such as posters, leaflets, press releases, still photos, trailers, making-of material etc. to SFC. |
| 3. |
Once the shooting is completed with the support of SFC and other related jurisdictional bodies, this support should be expressed in the film or promotion material in an appropriate manner. |
Article 9 Termination of Support
| 1. |
In case the applicant has committed a material breach of its obligations or for some other reason received two or more letters requesting correction from SFC and still has not faithfully complied to such request, SFC may immediately cease to provide support.

| 2. |
In the case that according to the judgment of the jurisdictional organization, unlike prior agreement the shooting location is in danger of being damaged or the subject of filming may be detrimental to the good image of the organization, SFC may request the applicant to terminate the shooting at the organization's request. |
Article 10 Liabilities
| 1. |
The filming support application made by the applicant shall construct the consent on the applicant's part to the regulations set out herein, and all civil, criminal liabilities that may arise due to the film made with SFC’s support lies solely with the applicant. |
